Cap d'Agde in French law: a sui generis situation

The Cap d'Agde Naturist Village occupies a particular legal position in France. On the one hand, it is subject to ordinary French law without any explicit exemption. On the other, an implicit body of case law and a historical administrative tolerance have created a de facto framework different from the one prevailing in the rest of the country.

Naturism: legal in France in dedicated zones

The practice of naturism is legal in France in zones specifically designated for that purpose — of which the Cap d'Agde Naturist Village is one. Nudity in these zones does not constitute an offence, even though it could be considered indecent exposure in other contexts.

The relevant articles of the Penal Code

Article 222-32: Indecent exposure

"Sexual exhibition imposed on the sight of others in a place accessible to public view is punishable by one year of imprisonment and a €15,000 fine."

Key to interpretation: the word "imposed". In a space where everyone is voluntarily present and an adult, exhibition may not be considered "imposed".

Article 222-33-2: Sexual harassment

Harassment — repeated insistence after a refusal — is a serious criminal offence, including in Cap d'Agde.

Article 226-1: Invasion of privacy

Capturing the image of a person without their consent in a private place: 1 year and €45,000. In Cap d'Agde, the clubs are considered private places — protection is at its maximum.

Local case law

The courts of the Hérault département have heard several cases linked to the Naturist Village. The general trend is towards a certain leniency for behaviour between consenting adults in the dedicated zones, and maximum severity for:

  • Anything involving minors
  • Non-consensual photographs
  • Harassment
  • Behaviour in the zones outside the village

Practical recommendation

The law is complex and its application variable. The best protection remains to always act within the framework of private establishments and to scrupulously respect the consent of every person.
